The Miranda Warning is a complex and intricate text for interpreters. There is historical contexts that should be considered by interpreters when attempting to interpret it, both on the SC:L exam as well in an interpreted event. Interpreters must understand the legal case that served to establish the Warning as well as when law enforcement is legally required to advise an individual of their rights under the Miranda Warning. This article will provide the historical and case law related to the Miranda Warning, a discussion of possible considerations for interpreters when interpreting the Warning, and identification of concepts contained in the Warning that maybe be problematic within an interpretation.

Educational Objectives:

  1. Participants will be able to identify and explain the historical case that established the Miranda Warning and governs law enforcement use of it.
  2. Participants will be able to analyze the Miranda Warning and identify implicit information that should be made explicit in any interpretation.
  3. Participants will be able to identify concepts contained in the Miranda that could be problematic in ASL and describe options within an interpretation.
